Flat-fee appeal evaluation

Appeal Evaluation

A flat-fee appeal evaluation for Florida attorneys: $1,500

Got a ruling you think is wrong? Before you or your client commit to the cost of an appeal, the Appeal Evaluation tells you whether the issues are worth pursuing. We review the order and the record, identify what was preserved, and give you a written assessment and a strategy call.

When attorneys use it

  • After an adverse final judgment
  • After a non-final order that may be appealable or reviewable by petition for writ of certiorari
  • When your client wants to understand the odds and the cost before committing
  • When the other side appeals and you need to know how strong their issues are

What’s included

  1. Record Review:We review the order or judgment and the key parts of the record.
  2. Preservation Analysis:We identify which issues were preserved and which weren’t.
  3. Standard of Review:We apply the standard of review to each issue.
  4. Realistic Assessment:We assess the realistic odds and the cost of appealing.
  5. Deadline Check:We flag the deadlines that matter, including the notice of appeal, rehearing, initial or answer brief, and/or cross-appeal.
  6. Strategy Call:We walk you through the assessment so you can decide how to proceed.

What you receive

A written assessment. Each issue, whether it was preserved, the standard of review, and our view of its strength.

A strategy call. We walk through every finding with you, with no clock running.

Price: $1,500 flat.

Scope: Records up to 1,000 pages. Larger records are quoted separately.

If you hire us for the appeal: The evaluation fee is separate from a full appeal engagement, but you’ll never pay twice for the same work. We start the brief with the record already reviewed and the issues already mapped.

The Appeal Evaluation is an initial assessment based on the order, the record provided, and the issues apparent at the outset. Appeals often evolve once full briefing begins: additional issues, record problems, or research needs can surface that weren’t apparent in an initial review. Our evaluation reflects our professional judgment at the time of review and is not a guarantee of any outcome or a final determination of every issue on appeal.

Timing matters

In most Florida civil cases, the notice of appeal must be filed within 30 days of rendition of the order. In other circumstances, the deadline is even sooner. Reach out as early as possible so there’s time to evaluate the case before the deadline.

How it works

Frequently asked questions

Who performs the evaluation?

A licensed Florida attorney, every time.

Is the evaluation fee credited toward the appeal?

No. But you’ll never pay twice for the same work: if you hire us, we start with the record already reviewed and the issues already mapped.

What if the record is over 1,000 pages?

Larger records are quoted separately. We’ll confirm the price before any work begins.

Is the evaluation a guarantee of the outcome?

No. It’s an initial assessment based on the record and issues apparent at the outset. Appeals can evolve once full briefing begins.

Can I use the Case Strategy Audit for an appeal instead?

No. The Case Strategy Audit is for trial-level cases. Appeals have their own process.

Do you handle criminal appeals?

No. We handle appeals in every area of civil law, but not criminal matters.
